Weapons Crimes

California prosecutors adopt a firm stance on weapons crimes, prioritizing public safety. They aggressively prosecute illegal possession, use of firearms, and prohibited weapons.

Prosecutors seek maximum penalties, leveraging enhancements for gang involvement or use in other felonies. They focus on deterring gun violence and enforcing strict state laws. This reflects California's commitment to reducing weapons-related crime.

For Example: Penal Code (PC) 29800

California Firearm Charges — Quick Guide

PC 25400 – Carrying Concealed. Concealed firearm on your person/in vehicle; knowledge of the firearm required.
PC 25850 – Carrying Loaded in Public. Loaded firearm in a public place/vehicle; stops must be lawful.
PC 29800 – Prohibited Person in Possession. Prior felony or specified offenses; constructive possession issues are common.
PC 29180 – “Ghost Guns.” Making/possessing unserialized frames/receivers; serialization deadlines and transfer rules matter.
PC 30600 – Assault Weapons. Manufacturing/sale/transport of banned configurations.
PC 32310 – Large-Capacity Magazines. Manufacture/import/sale/transfer of LCMs; litigation is evolving—charging practices vary.

Defenses we use

  • Illegal stop/search, invalid warrant scope, or Miranda issues.

  • No knowledge/possession (shared vehicles/homes).

  • Lawful transport exceptions; residency and storage defenses.

  • Serialization compliance (for PC 29180).

  • Re-characterizing conduct (e.g., ammo only).

Tip: For uses inside the home, see Castle Doctrine (PC 198.5)—link to that page from here.

Quick FAQs

  • Q: Is a gun in a glove box “concealed”?
A: Often yes; lawful transport generally requires a locked container and separation from ammo.

  • Q: Can I carry loaded on my property?
A: Home/property rules differ from public places—context matters.

  • Q: What if I didn’t know a gun was in the car?
A: Knowledge/possession is an element; we present evidence showing lack of awareness or control.
